Litigation
At Westbury, we consider litigation to be a last resort in the recovery process. However, where debts are disputed, delayed, or continually ignored, legal action can often provide the most effective route to resolution.
Our experienced account managers will advise you when litigation may be appropriate and guide you through every stage of the process clearly and professionally. We understand that legal proceedings can appear daunting, which is why we ensure you remain fully informed throughout.
We work alongside experienced solicitors who specialise in debt recovery and remain fully up to date with current legislation and regulatory requirements, including the latest Pre-Action Protocol procedures relating to outstanding invoices and commercial debt recovery.

Ongoing Case Management & Advice
Where necessary, we can assist with issuing claims through the County Court in order to pursue payment of outstanding debts. Should a claim remain unpaid, we may also recommend applying for a County Court Judgment (CCJ), which can significantly impact the debtor’s ability to obtain credit and may remain on their record for up to six years.
Our aim is always to pursue the most effective and commercially sensible outcome for our clients while keeping the process as straightforward and stress-free as possible.
Please note that legal fees and court costs are separate from our standard commission rates.
